Total revenue decreased 3% for the quarter, and net income from continuing operations was $0.00 per diluted share, which wasn't too good in comparison to last year's number, which was $0.17 per diluted share. Total revenue was flat for the year, and net income from continuing operations was $0.57 per diluted share versus $0.77 per diluted share in the previous fiscal year.

CKE Restaurants, which operates the Carl's Jr. and Hardee's brands, did not impress analysts, as earnings expectations for the quarter were missed by two pennies. I myself wasn't too impressed with the entire report. Same-store sales increased 0.9% at Carl's Jr. and 2% at Hardee's for 2007 -- I'm not going to jump up and down over that bit of news. In addition, costs are up because of inflationary pressures, and revenues have obviously been challenged. There's not a lot that I like about this story.

CKE's stock is certainly on the lower end of its 52-week range, but I can't say it is necessarily cheap; it closed yesterday at $12.45 -- the high for the year on the stock is $23.24. This is a situation that calls for an old standby: "There are better opportunities out there in this space." For me personally, if I'm looking at the burger business, I'm way more likely to consider a McDonald's (NYSE: MCD), a Burger King (NYSE: BKC), or a Wendy's (NYSE: WEN) before I entertain CKE as an investment idea. Although they don't do burgers (so far as I know), I'd even look at a Yum! Brands (NYSE: YUM) before CKE. These companies have better brand equities in my estimation. CKE may turn itself around, but I just wasn't impressed by my look at its data.

So when I saw the news this week about how CKE Restaurants (NYSE: CKR) restaurants, Hardee's and Carl's Jr., have agreed to start purchasing a very small percentage of their pork and eggs from cage-free animals, I was wowed at the headlines. "Cage-free eggs!" an email from a colleague read.

%Gallery-7924%
Why is this the funnest news all month? Because of the very famous pin-up girls involved in the dispute. Paris Hilton is, after all, famous for her extremely sexy Carl's Jr. ads (I'd venture to say they are the pinnacle of her sordid career). Alicia Silverstone has made headlines with her racy PETA ads that were pulled off the air thanks to their nearly-naked nature. So in the cage match between Paris Hilton and Alicia Silverstone, I could have called it: smart Alicia whooped Paris' lingerie-clad booty with a (slightly happier) hen.
I was excited -- I love news about cage-free eggs, especially when Paris is involved -- until I read the story, which (as Zac Bissonnette points out) details the agreement between PETA and CKE, under which the chain agrees to buy 15% of its pork products from pigs whose suppliers fit a very narrow definition of humane treatment and 2% of its eggs from chickens not kept in wire cages. Yep. TWO percent. There doesn't appear to be any greater promise than that down the road (though happier sows are promised to make up 25% by 2009).

Evidence suggests that part of the problem could be a lack of supply -- after all, using wire cages is famously efficient or it wouldn't have been developed in the first place. And cage-free chickens aren't necessarily any better treated than those in cages; so it's an open question whether PETA should be spending its time advocating for their eggs. Chickens who aren't in cages are typically subjected to a number of indignities meant to limit their aggression (you'd be aggressive too if you were kept in a big stinky barn with thousands of your family members), from beak-trimming to wing-clipping to keeping them in twilight around the clock.

And it pisses me off a bit that CKE is getting good PR for a move that is the teeniest promise all year. In the struggle for recognition as an animal-friendly company, I'm going to have to give Hardee's and Carl's Jr. an "Incomplete."

Permalink | Email this | Linking Blogs | Comments

PETA reaches deal with Hardee's and Carl Jr. (CKR)

Filed under: Products and services, Marketing and advertising, CKE Restaurants (CKR)
While People For the Ethical Treatment of Animals attracts a lot of flack (not to mention a South Park episode) for its perceived "militancy", the organization should be commended for its latest coup.

According to the Associated Press, CKE Restaurants (NYSE: CKR) will begin purchasing eggs and pork from suppliers who do not keep their livestock in cages or crates. The concessions may seem relatively modest, but CKE is just the second chain to adopt these standards after Burger King (NYSE: BKC) made similar changes in March. The chain will:
Immediately begin purchasing 15 percent of its pork from suppliers that do not use metal "gestation crates" to confine sows, and increase that to 25 percent by 2009.

Purchase 2 percent of its eggs from suppliers whose hens are not kept in wire cages by July 2008.

Issue a statement to poultry suppliers stating it will "give consideration to approved suppliers who actively explore and test controlled-atmosphere stunning systems," which animal rights groups consider the most humane way to slaughter chickens.

These are hardly the kinds of changes that will have great PR value: "SWEEPSTAKES! ONE IN 50 EGGS COMES FROM A HEN THAT WAS NOT KEPT IN A WIRE CAGE!"

Hopefully more positive changes will come in the years ahead, but for now, we should give CKE credit for doing something.

See also: Cage-free eggs, are they really better?

Read | Permalink | Email this | Linking Blogs | Comments

Thursday Market Rap: CC, SLW, DHI, KBH, and CKR

Filed under: Circuit City Stores (CC), D.R.Horton (DHI), KB HOME (KBH), Options, Silver Wheaton (SLW), CKE Restaurants (CKR)

Stocks moved mildly lower today taking a break from the bullish buying over the last two days. This is not really a bad sign, after all the S&P 500 gained 3.5% Tuesday and Wednesday so losing 0.67% today still leaves it up 2.8% since the Fed cut. September equity options expire tomorrow so we may see some some extra volatility gong into the end of the week.

There is scary news all around -- the credit markets are seizing up, mortgage-backed securities are plummeting in value, even Wal-Mart Stores (NYSE: WMT) and Home Depot (NYSE: HD) have expressed worry lately that the stalwart American consumer is losing her resolve to spend.

Yet no sooner do investors panic and sell their stocks, than the market gets some relief. Central bankers around the world step in with billions in short-term loans, giving the debt markets some wiggle room. Or a hot growth company provides some upbeat news -- VMware's hot initial public offering on Aug. 14 was a nice respite from all the bearishness, for example. Or investors just start to realize there are lots of great companies getting much cheaper while the economy really is still humming along just fine.

Suddenly the Dow Jones industrial average will leap 50 points in an hour and we are left kicking ourselves for not picking up some shares of a favorite stock while it was down -- until the next market swoon when we wonder why we didn't get out when the gettin' was good.

Here's a way to deal with all the spikes and swoons: Embrace the rollercoaster. Now that the Dow Jones industrial average is back below 13,000 (weren't we just celebrating Dow 14,000?), you can take advantage of the volatility to buy some solid stocks you've always wanted to own at a sale price. No one knows where the market will go next. But if your plan is to hold quality stocks for the long term, a downdraft can provide a good buying opportunity.

How do you find solid bets? We asked some of our best investment bloggers to give us their top picks for today's volatile market. They came up with a mix of choices - everything from core blue chips like General Electric (NYSE: GE) and Coca-Cola (NYSE: KO), to riskier plays, like Steven Madden (NASDAQ: SHOO) and China's Huaneng Power International (NYSE: HNP). Peruse our gallery to see why stocks you may know well, like Starbucks (NASDAQ: SBUX), Boeing (NYSE: BA) or Target (NYSE: TGT) are buys, or learn about companies you may never have heard of - like South Korean steel maker Posco (NYSE: PKX) or train car maker FreightCar America (NASDAQ: RAIL).

Of course, we don't think you should time the market (we hear ya' Zac!). This isn't the time to bet the farm, even on a big brand name blue chip. But if the recent sell-off is causing you stress, you may find relief in identifying stocks that could be safe or highly profitable picks to stash away for the long term.

CKE Restaurants (NYSE: CKR), parent company of Hardee's and Carl Jr.'s is suing Jack in the Box (NYSE: JBX) for a television commercial which allegedly suggests that the company's famous angus burgers are made from cow anus (see YouTube video above).

This is one of the more entertaining legal cases I've seen in awhile. According to the Associated Press, "CKE claims the ads create the misleading impression that Jack In The Box's new 100 percent sirloin burgers use a better quality of meat than the Angus beef used by Carl's Jr. and Hardee's. CKE claims the spots confuse consumers by comparing sirloin, a cut of meat found on all cattle, with Angus, which is a breed of cattle."

According to CKE CEO Andrew F. Puzder "They're not being funny. They need to stop misleading people about what Angus beef is."

Here's the problem: They actually are being funny. And I certainly don't claim to be a legal expert, but I think that part of Jack in the Box's defense is going to be "Lighten up and learn to take a joke."

Puzder said that CKE had asked Jack in the Box to pull the ad, but the company refused, pointing to a Carl Jr.'s ad which suggested that its milkshakes were better than the competition. Here's the best part: Puzder said the comparison was not valid because they had not claimed that competitors made their milk from cow anuses.

This whole "scandal" seems like a tempest in a tea pot to me. Jack in the Box's commercial was a clever pun on the word "angus" and certainly not misleading. Did anyone watching it really come away thinking that angus burgers were made from anuses?

The deal allows Wendy's to be the only major fast-food restaurant chain to offer a proprietary blend of Folgers Gourmet Selections coffee and will become part of Wendy's new breakfast menu.

What's that you say, "Breakfast menu?"

Yes folks, Wendy's just isn't for lunch or dinner anymore (or dessert - mmmm Frosty's). You can now eat Wendy's for every meal of the day. By the end 2007, Wendy's expects to have 20-30% of its North American restaurants serve breakfast along with premium Folgers coffee.

Wendy's is definitely throwing its hat into a very crowded ring. The fast-food breakfast market is growing at almost three times the rate of the overall market, with Burger King (NYSE: BKC), McDonald's (NYSE: MCD), Arby's, a unit of Triarc Co. (NYSE: TRY), Carl's Jr and Hardee's, both owned by CKE Restaurants (NYSE: CKR) and even Starbucks (NASDAQ: SBUX) offering similar on-the-go breakfasts to consumers. Papa John's (NASDAQ: PZZA), Dunkin Donuts and Chick-fil-A are planning new breakfast products as well. What's going to be so different to make me go to Wendy's?

When looking at the coffee aspect, one has to recall last year's Canadian Business magazine taste test between McDonald's "Café Roast" and Starbucks coffees. I'm sure all the companies I mentioned above serve some brand of coffee. Wendy's is really walking into a competitively caffeinated situation. We also can't forget about
<place w:st="on"><city w:st="on">Seattle</city></place>
's "Sexpresso" baristas, but that's competition on a different level.

McDonald's comes late to the Angus burger trend. Rivals Burger King Holdings, Inc. (NYSE: BKC), Hardees and Carl's Jr. -- the latter two part of CKE Restaurants, Inc. (NYSE: CKR) -- have been selling the premium burgers for years. In fact, Hardees has just announced a new addition to its menu, a patty melt style Thickburger, also made with Angus beef.

The new burgers are part of McDonald's ongoing efforts at revitalization. Those efforts have included the introduction of new beverage choices, such as iced coffee, which is also expected to spread throughout the U.S. soon. Another part of that effort is a new advertising campaign, emphasizing career opportunities at McDonald's -- no doubt to try to change its image as a source of low-paying, dead-end jobs.

The revitalization appears to be working. Back in April, McDonald's reported a strong quarter, especially internationally. The share price has risen since then, and reached a 52-week high this morning.

Read | Permalink | Email this | Linking Blogs | Comments

Analyst initiations 4-18-07: EBAY, CA, CAH, CKR & FIRE initiated today

Filed under: Before the bell, eBay (EBAY), CA Inc (CA), Analyst initiations, Cardinal Health (CAH), CKE Restaurants (CKR)
MOST NOTEWORTHY: CKE Restaurants (CKR), Cardinal Health (CAH), eBay (EBAY) and CA Inc (CA) topped today's noteworthy initiation list today:
(NYSE:CKR) had little choice but to say goodbye to the original Hardee's franchise in Rocky Mount, North Carolina.

The location, which was opened in 1961, was shut more than a decade ago. Birds flew out of the interior roof when it was demolished, according to the Rocky Mount Telegram. It's going to be remade into a park. The whole area around the restaurant is part of an urban renewal project, according to Peter Varney, an assistant city manager.

"It's an area that's coming back to life," Varney told me in an interview.

There was some talk about converting the restaurant into a museum of some sort, but that never got anywhere. Interestingly, Hardee's is cutting its ties with the past less than one month after Wendy's International Inc. (NYSE:WEN) shut its original location too.

Change in this case is a good thing.

Businesses both large and small can't afford to be sentimental. Chances are you'll see a family or two, and chances are, the young children will be in possession of a hamburger Happy Meal. And if the family you're watching is anything like mine, or my colleague's, you'll see a pregnant mom (that's me) or dad, with an empty Quarter Pounder wrapper, hungrily eyeing the last bites of the child's burger.

Maybe it was a sight like that that prompted franchisee Scott Frisbee, whose family owns 17 McDonald's restaurants in and around Anaheim, California, to develop the idea that McDonald's needed a premium burger. Maybe it was those ubiquitous commercials for the "six dollar burger" at rival Carl's Jr., a unit of CKE Restaurants, Inc. (NYSE:CKR), and the fact that his menu had no competitive item. Maybe he was just hungry. Either way, the progress of McDonald's Third Pounder from concept to its appearance on California menus is remarkable for its speed -- not to mention its success.

At $3.99, the burger is the most expensive sandwich the company has ever offered -- seemingly counter to McDonald's place in the country's subconscious as the cheapest place to get a family meal. At 720 to 840 calories depending on options, the sandwich seems contrary to America's hopeless striving to become healthier. And after a string of less-than-stellar new menu items in the 80s and 90s, the fast food chain had slowed to focus on its menu standards -- so however did this come to fruition so quickly and to such obvious acclaim?Neither McDonald's or Frisbee care to explain the answer to most of the obvious questions, how this burger can exist in a world that wants to use healthier oils and reduce its waistline. It is, after all, a few decades since "Hungry Man" was all the rage. But when you look a little closer, when you start getting out your game theory boards and watching the ping-pong of products in the burger marketplace, you realize: this was meant to be. It had to be.

The burger, which uses Angus beef and a denser bun ("more of a roll flavor," says Scott), is the very opposite of your concept of a fast-food burger -- small, no-frills, almost slider-esque. But that's really the point. McDonald's is losing customers to places like Carl's Jr. and the Jack in the Box, where premium burgers are being positioned as category killers. In another market, casual dining restaurants are siphoning off the customers who "graduate" to more beefy -- and expensive -- options.

And, who are McDonald's two target markets? One of them is the teenager and young adult market, the kind who are hanging out in McDonald's at 4 p.m. and at 4 a.m. This burger is for those in the demographic who are about to graduate to Red Robin or Chili's, but I don't think that's the major focus. The other market -- and far more important to McDonald's success -- is the young family market. The ones who don't go to Red Robin because the kids won't sit still, and who wants to pay $5.95 plus tip for your three-year-old to suddenly declare he HATES mayonnaise and won't touch any of his burger? The ones who are watching the commercials that attempt to make them feel good about their choice -- made because they're too busy, or broke, or stressed out to go anywhere nicer or cook at home. You've seen the ads, the ones which position McDonald's as a way to spend quality time with your kids. (Subliminal: not only should you not feel guilty for going to McDonald's, you should feel great! You're creating memories!)

In a word, this burger is for the dads. (And, in my case, the pregnant mamas, although I don't think that was really the reason the top brass in McDonald's board room put their rubber stamp on the concept.) They're hungry, and they're driving. You might be appealing to mom's guilt, but dad? Let's go straight to his belly. It's a strategy that's a few thousand years old, and it's still going to work.

Permalink | Email this | Linking Blogs | Comments

Paris Hilton: In-N-Out craving has her on the outs with Carl's Jr.

Filed under: Bad news, Marketing and advertising, CKE Restaurants (CKR)
Note to advertisers: be really careful who you pick to pitch your products.

Sure, you want a big name. You want convincing. You want sexy. But do you really want someone who doesn't even like your product? (Hint: no!)

Yesterday, Paris Hilton plead 'no contest' to one count of alcohol-related reckless driving -- she'll pay a fine and be on probation for 36 months. All this because she was really hungry (and drunk) and "wanted to have an In-N-Out burger."

Which all would be a juicy story, and par-for-the-course with the idle rich like Ms. Hilton. Except that she's a former spokesperson (spokesmodel?) for rival Carl's Jr., a unit of CKE Restaurants, Inc. (NYSE:CKR). There was so much egg (or was that hamburger grease?) on everyone's face, the incident made Business 2.0's list for dumbest moments in business.

I'll give this: you probably don't want your spokespeople drinking and driving. But if they do, and they're caught in the act and interviewed as to what was going on, wouldn't you want them to say, "I really wanted a Carl's Jr. burger?"

Pick your spokespeople like you pick your CEOs: make sure they love 'em a good ____ [your product goes here]. It will at least make for a good crawl on CNN.
